Video Consultation

Introduction

1.1 By accessing and using the Video Consultation Services, you acknowledge and agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using the Services.

Eligibility

2.1 Video Consultation Services are available to individuals who are 18 years of age or older. By using the Services, you represent and warrant that you are at least 18 years old.

2.2 If you are accessing the Services on behalf of a minor, you represent and warrant that you have the legal authority to provide consent on behalf of the minor, and you accept these Terms on their behalf.

Provision of Services

3.1 Video Consultation Services enable individuals to remotely consult with healthcare professionals employed or contracted by Elios Clinics, subject to the availability of healthcare professionals.

3.2 Video Consultation Services are not intended to replace in-person medical consultations. The Services are provided solely for informational and non-emergency purposes. In case of a medical emergency, please contact emergency services immediately.

3.3 We make reasonable efforts to ensure the security and confidentiality of the video consultations. However, due to the nature of online communications, we cannot guarantee absolute privacy or security. By using the Services, you acknowledge and accept these inherent risks.

Medical Advice and Limitations

4.1 The Video Consultation Services are provided by qualified healthcare professionals who will evaluate your medical condition and provide medical advice based on the information you provide.

4.2 You understand and agree that the healthcare professionals providing the Services cannot provide a comprehensive diagnosis or treatment without conducting an in-person examination. The Services are limited to the information and visual cues available through video consultation.

4.3 The advice provided during a Video Consultation is based on the healthcare professional’s professional judgment and the information you provide. It may not be accurate or appropriate in all cases. You should not solely rely on the information provided during a Video Consultation for making medical decisions.

Privacy and Confidentiality

5.1 We are committed to protecting your privacy and maintaining the confidentiality of your personal and health information. Our privacy practices are governed by our Privacy Policy, which can be accessed on our Website.

5.2 During a Video Consultation, we will collect and process personal and health information in accordance with applicable laws and regulations. By using the Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

Fees and Payments

You may not reproduce, distribute, or disclose such materials to third parties without obtaining prior written consent from Elios Clinics.

Termination

8.1 We reserve the right to suspend, terminate, or restrict your access to the Video Consultation Services at any time and for any reason, without prior notice or liability. Reasons for such actions may include, but are not limited to, violation of these Terms, abusive behavior, or non-payment of fees.

8.2 Upon termination, you will no longer have access to the Video Consultation Services, and any rights or licenses granted to you under these Terms will cease immediately.

Limitation of Liability

9.1 To the fullest extent permitted by applicable law, Elios Clinics and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Video Consultation Services or these Terms, including but not limited to, loss of profits, data, or any other intangible losses.

9.2 You acknowledge and agree that the Video Consultation Services are provided on an “as is” and “as available” basis, without any warranties or representations of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Governing Law and Dispute Resolution

10.1 These Terms shall be governed by and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

10.2 Any dispute arising out of or in connection with these Terms or the Video Consultation Services shall be subject to the exclusive jurisdiction of the courts of United Kingdom.

Modifications

11.1 We reserve the right to modify or update these Video Consultation Terms and Conditions at any time, without prior notice. Any changes will be effective immediately upon posting on the Website. It is your responsibility to review these Terms periodically for any updates.

11.2 By continuing to use the Video Consultation Services after any modifications or updates to these Terms, you acknowledge and agree to be bound by the revised Terms.

Appointments

12.1 For appointments booked and confirmed by patients who have paid for a consultation, adherence to the scheduled time is essential. Upon confirmation of the appointment, patients are expected to attend punctually. In the event of a missed appointment, the standard fee for a consultation will be charged again for rescheduling. This policy ensures the efficient utilisation of our healthcare professionals’ time and maintains fairness for all patients seeking our services. We encourage patients to honour their appointments to receive timely and effective care.

12.2 In the scenario where a patient is enrolled in a free program through a third party and is offered a consultation, our clinic extends a courtesy by providing an initial appointment. Should the patient accept the appointment time but fail to attend the consultation, a second appointment will be offered as a gesture of understanding and flexibility. However, if the patient misses the second appointment for any reason, they will be required to bear the costs associated with subsequent consultations, as outlined in our fee structure available on our website. This policy ensures the equitable utilisation of our resources and encourages responsible engagement with our healthcare services.

How we contact you

We may contact you by email to the email address provided in your Patient account (PA), by written communication to the postal address provided in your PA account or by a general notice on the website.

Services and Charges Our services

Following referrals from GPs and Consultants (‘Referrers’), we transfer patients to the appropriate Elios Clinic where they are offered appointments with expert clinicians (Elios Clinic clinicians). Following their appointments, patients who suffer from conditions which may not be treated effectively with conventional medicinal treatments may be prescribed cannabis-based medicinal products (CBMPs) where it is believed that they could reasonably derive clinical benefit through their use of the prescribed products. Our services comprise the organisation of appointments at Elios Clinics only which may or may not lead to a prescription of a CBMP. We do not, and Elios Clinics do not purchase, stock nor sell CBMPs. Our clinical services are provided using qualified GMC registered medical professionals based in the UK and each engaged by an Elios Clinic franchisee. We only offer services to patients from the UK. Our website is solely for the promotion of our services in the UK. Unfortunately, we do not accept requests for appointments from addresses outside the UK.

If you are a Referrer

You agree that only GPs or Consultants based in the UK can refer their patients to us for an appointment at an Elios Clinic. You understand that falsifying referrals constitutes a criminal offence, which could lead to criminal prosecution. You can refer your patients by phone, email or via our website.

Appointments are subject to availability and remain at our entire discretion, subject to the Terms and Conditions agreed by the patient upon booking of the appointment. We reserve the right to request you or your patient additional information regarding an incomplete referral.

Terms of treatment and prescriptions

You understand that there is no guarantee that the Elios Clinic clinician will provide your patient with a prescription for CBMPs following their appointment. You agree that your Elios Clinic clinician might, if they consider it clinically appropriate, attempt conventional medical treatment before prescribing your patient CBMPs. You understand that prescriptions will only be issued where clinically appropriate, lawful and after an appointment has occurred, subject to your patient’s signature of the Terms of Treatment which will be provided to your patient during their appointment if they are prescribed CBMPs.

We reserve the right to change our services to reflect any changes in applicable legislation or for any other business reason. We will always make these changes available to you on our website.

We may amend these Terms from time to time. Every time you wish to use our services, please check these Terms to ensure you understand the Terms that apply at that time. Refund & Cancellation policy

We require the consultation fee to be paid in full to secure your booking and begin the complete eligibility check process. In addition, the fee includes a non-refundable deposit of £30 to cover our administrative costs for new consultations and consultations for transferring patients.

Before booking a consultation, our team carries out an initial eligibility check. Once the consultation fee is paid, we commence a full eligibility check, which includes contacting your GP and reviewing your medical records. If we deem you ineligible for a medical cannabis consultation, based on our inclusion and exclusion criteria, we will refund the consultation fee minus the £30 deposit.

Cancellation of consultations is permitted with at least 48 hours notice by email or phone, and a refund will be given minus the £30 deposit. However, if the appointment is cancelled with less than 48 hours notice or if you fail to attend, we reserve the right to withhold the entire consultation fee.

Discharge Procedure:

Patients wishing to be discharged from our services are required to adhere to the following procedures:

  2. Third Party Relationships and Partnerships: Patients enrolled in our services through third-party relationships or partnerships, wherein services are provided free of charge, are subject to specific terms:
  3. Lock-in Period: Patients availing themselves of free services through third-party arrangements are contractually bound for a predetermined period. This period is typically six months or yearly, depending on the plan chosen.
  4. Discharge Options: Patients within this arrangement may request discharge from our services upon completion of the lock-in period by paying the quarterly fee for treatment and consultations. This fee typically covers one initial consultation, one follow-up consultation, and one repeat prescription.

iii. Immediate Discharge: Patients opting for an immediate discharge before the completion of the lock-in period, despite availing themselves of a free consultation, are required to pay the prescribed discharge administrative fees.

Transfer of Patients:

Patients may request transfer to alternative healthcare providers or services. The following guidelines apply:

  1. Transfer Requests: Patients desiring transfer to other healthcare providers or services must submit a formal request to our administration.
  2. Transfer Process: Upon receiving a transfer request, our administration will facilitate the transfer process, ensuring all necessary medical records and documentation are transferred securely and efficiently.
  3. Financial Obligations: Patients are responsible for any outstanding financial obligations before the transfer process can be initiated.
  4. Discharge Fees: In the event of a transfer request, discharge fees may apply as per the aforementioned discharge procedures.

Exceptions:

Exceptions to the discharge and transfer procedures may be considered on a case-by-case basis, subject to review by our administration and compliance with applicable regulations.

Elios Clinics is committed to facilitating the discharge and transfer processes for our patients with efficiency and transparency. We strive to ensure that patients’ rights and obligations are clearly outlined, fostering a seamless transition when necessary while maintaining the quality and integrity of our healthcare services.

Medical Records and Consent

By providing your consent through our website, you authorize Elios Clinics to request and obtain your medical records from your GP or other relevant healthcare providers. Upon receiving your signed consent form, we will either request the records directly from your GP or utilise our trusted partners, partners including other GP practices and NHS pharmacies, to expedite the process. These partners help ensure timely access to your medical history, which is vital for assessing your eligibility for medical cannabis treatment.Once obtained, your medical records will be reviewed by our qualified clinicians and securely stored on our servers as part of your patient records with Elios Clinics. We take the privacy and security of your information seriously. Your medical records will only be accessed by authorised personnel, including our consultants, clinicians, and pharmacists, and will never be shared with any third party outside of Elios Clinics. The information is solely used for the purpose of understanding your medical history and ensuring you receive appropriate care and treatment recommendations.We will not request your medical records unless explicit consent has been provided, and you have completed and signed the required consent form on our website/platform. Your consent ensures that we are authorised to carry out this request in compliance with all legal and ethical obligations.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

  • limit or exclude our or your liability for death or personal injury;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;

Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to cancel the appointment and receive a refund for any services you have paid for but not received. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.

Transfer of These

Terms We may transfer our rights and obligations under these Terms to another organisation. We will always tell you if this happens and we will ensure that the transfer will not affect your rights under the Terms. These Terms are between you and us. No other person shall have any rights to enforce any of its terms. If a court finds part of these Terms are void, unenforceable or illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

Governing Law

These Terms are governed by English law and the English courts shall have jurisdiction in respect of any disputes arising under these Terms.

Subscription Plans

The Subscription Plan provides patients with access to treatments at Elios Clinics on a recurring basis. The Subscription Plan costs £60 per quarter. Payments will be automatically charged to the payment method provided at the time of subscription. Billing occurs every three months (quarterly). The first payment will be charged upon enrollment, and subsequent payments will be charged every three months thereafter.

Subscription Activation and Renewal:

Your subscription will be activated upon successful payment of the initial subscription fee. Your subscription will automatically renew every quarter unless canceled in accordance with the cancellation policy below.

Payment Terms:

All payments must be made via the payment methods specified on the Website. By providing payment details, you authorize us to charge the applicable subscription fee. If a payment fails, you will be notified and given an opportunity to update your payment details. If payment is not successfully made within 7 days, your subscription may be suspended or terminated.

Cancellation and Refunds:

You may cancel your subscription at any time by contacting us. Cancellation will take effect at the end of the current billing cycle. No refunds will be provided for any payments already made, including for any unused portion of the subscription period.

Changes to Subscription Terms:

We reserve the right to change the subscription fee or any other terms at any time. You will be notified at least 30 days in advance of any changes. If you do not agree with the new terms, you may cancel your subscription before the changes take effect. We may update these Terms from time to time. Any changes will be posted on the Website, and your continued use of the Subscription Plan will constitute acceptance of the new terms.

User Responsibilities:

The Subscription Plan is available to individuals aged 18 and over. By subscribing, you confirm that you meet these eligibility requirements. You are responsible for maintaining the accuracy of your account information, including contact and payment details.

Termination:

We reserve the right to terminate or suspend your subscription at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. Upon termination, your access to the Subscription Plan will cease, and no further charges will be made to your payment method.
